Agreement to Terms

By accessing or using the services provided by NextGen Cyber Academy LLC ("we," "us," or "our"), including our website (nextgencyberacademy.com), bootcamp programs, quizzes, Discord community, and related communications, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Services

NextGen Cyber Academy LLC provides:

• Cybersecurity career training and bootcamp programs
• Online readiness assessments and quizzes
• Educational content and resources
• Discord community access
• Career coaching and mentorship
• Optional certification preparation sessions
• Resume revision services

Eligibility

You must be at least 18 years old to use our services independently. Individuals aged 14-17 may use our services with verified parental or guardian consent and supervision. By enrolling a minor, the parent or guardian agrees to these Terms on behalf of the minor and assumes responsibility for the minor's use of our services. We reserve the right to request proof of parental consent at any time. We collect this consent on a short form after purchase and confirm it through a one-time link we email to the parent or guardian.

Account and Registration

When you create an account, join our waitlist, or enroll in a program, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your account credentials confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity under your account

Bootcamp Enrollment and Payments

Bootcamp tuition is $997 per student. You can pay in full, use split pay, or reserve your seat with a $197 seat deposit and pay the balance before enrollment closes.

Waitlist

• Joining the free waitlist does not guarantee a seat in the bootcamp
• Waitlist members will be notified when enrollment opens
• Paid enrollments receive priority over free waitlist entries

Full Payment ($997)

• One payment of $997 covers full tuition and guarantees your enrollment in the cohort you enroll for
• Non-refundable once paid

Split Pay (2 payments of $498.50)

• The first payment of $498.50 is charged at enrollment, and course access begins at that time
• The second payment of $498.50 is charged automatically to the same payment method one month after the first payment
• By choosing split pay, you authorize NextGen Cyber Academy LLC to make both charges
• If the second payment fails, we will ask you to update your payment method, and access may be paused until the balance is paid
• Both payments are non-refundable, including the second payment, and the full $997 remains owed if you stop participating

Seat Deposit ($197)

• A $197 deposit reserves your seat in the cohort you pay it for and is applied toward your $997 tuition
• The remaining balance of $800 is due by the enrollment close date for that cohort. For Cohort 1, the balance is due by Tuesday, October 13, 2026 at 11:59 PM ET
• You can pay the balance as one payment of $800 or as two payments of $400. Both payments must be made by the balance due date
• Course access begins when your tuition is paid in full
• Deposits are non-refundable
• If the balance is not paid in full by the due date, your seat is released and your $197 deposit becomes a credit toward tuition for a later cohort within 6 months of the due date. The credit has no cash value and cannot be refunded

Promotional Codes and Referral Discounts

• Discount codes apply only as stated in the offer, cannot be exchanged for cash, and cannot be combined unless the offer says so
• Referral rewards are earned only for verified signups or enrollments, as described in the referral program

Resume Revision Service ($5)

• One-time payment for professional resume review and feedback
• Non-refundable once the service has been delivered
• Turnaround time varies based on demand

Premium Discord Access

• Paid subscription for enhanced Discord community features
• Non-refundable after access has been granted
• We reserve the right to revoke access for community guideline violations without refund

Refund Policy

All sales are final. All payments made to NextGen Cyber Academy LLC are non-refundable, including but not limited to:

• Full payment ($997): Non-refundable
• Split pay installments (2 payments of $498.50): Non-refundable, including the second installment
• Seat deposits ($197): Non-refundable. An unpaid deposit becomes a credit toward a later cohort as described above, not a refund
• Resume Revision ($5): Non-refundable
• Premium Discord Access: Non-refundable

By making a payment, you acknowledge and agree that all transactions are final and no refunds will be issued under any circumstances, except in the following case:

• Cohort cancellation by NextGen Cyber Academy LLC: If we cancel a cohort and are unable to reschedule, all payments (including deposits and installments) will be fully refunded

No chargebacks: You agree not to initiate a chargeback or payment dispute with your bank or credit card company for any completed transaction. If a chargeback is initiated, you agree to reimburse NextGen Cyber Academy LLC for any fees incurred as a result, and your access to all services will be immediately revoked.

Referral Program

Our referral program lets people who join it ("referral partners") earn a commission when someone they refer enrolls in the NextGen Cyber Bootcamp. By joining the program, including by replying AGREE to our Discord bot or submitting our referral program sign-up form and confirming your email address, you agree to these Terms of Service and to this section.

Who can join

• You must be at least 18 years old and able to give us US tax information (IRS Form W-9)
• We may accept or decline any request to join, and we may remove any referral partner from the program
• Referral partners are independent. Joining the program does not make you an employee, agent or partner of NextGen Cyber Academy LLC, and you may not speak for us

Your referral link and code

• Each referral partner gets a personal referral link and referral code. A purchase counts as your referral when the buyer uses your code at checkout (your link applies it automatically), when the buyer first signed up with us through your link within 90 days before enrolling, or when we credit the purchase to you at our discretion
• If more than one of these applies, a referral code used at checkout counts first. Otherwise, the first referral link the buyer signed up through counts
• Only one code can be used per checkout, so your code cannot be combined with other discount codes, such as a waitlist code
• Your code takes $50 off the buyer's first payment, as shown at checkout. Codes have no cash value

Commissions

• You earn a $100 commission for each referred student whose bootcamp tuition is paid in full: when they pay in full, when the second split-pay payment succeeds, or, for a seat deposit, when the $800 balance is paid. Monthly payment plans do not earn a commission
• One commission per student, even if more than one referral partner referred them
• Your own purchases do not earn a commission, including purchases you make under another name or email address
• A commission is approved 30 days after it is earned if the payment has not been refunded or disputed. A refund or chargeback before we pay you cancels the commission. If a referred payment is refunded or charged back after we pay you, we may deduct that commission from future payouts or ask you to return it

Payouts and taxes

• We pay approved commissions by PayPal, Zelle or a similar method within 30 days after approval. Tell us how you want to be paid at [email protected]
• We will ask for a Form W-9 before your payouts reach $600 in a calendar year and may hold payouts until we receive it. We report payments to tax authorities when the law requires it (for example, on Form 1099). You are responsible for any taxes on your commissions

How you may promote NextGen

• Clearly disclose that you earn a commission whenever you share your link or code or recommend NextGen, as the Federal Trade Commission requires. For example: "I earn a referral commission if you enroll through my link"
• No spam: no unsolicited bulk emails, texts, direct messages or calls, and no posting your link or code where a site or group does not allow it. Do not message members of our Discord community to promote your link or code
• No misleading claims: never promise jobs, salaries, income, certifications or results, describe the bootcamp, its price and its terms accurately, and do not invent deadlines or discounts
• Do not present yourself as NextGen Cyber Academy or its staff, create websites, ads or social media accounts that could be mistaken for ours, or bid on our name in paid search ads
• Do not offer cash back or other rewards of your own to get people to use your link or code
• Do not aim your promotion at people under 18. Students 14 to 17 need a parent or guardian's consent to enroll, so speak with the parent or guardian

Changes and ending the program

• We may change or end the referral program at any time, including the commission amount and these rules. Changes apply to purchases made after they are posted, and commissions already earned are paid under the rules in place when they were earned
• If you break these rules or act dishonestly, for example with fake or self-referrals, spam or misleading claims, we may cancel your unpaid commissions and remove you from the program

Text Message Program

Program name: NextGen Cyber Academy Text Messages, sent by NextGen Cyber Academy LLC from (470) 706-1191.

What we send: non-marketing text messages about your enrollment (enrollment confirmations), cohort start dates and deadlines, class reminders and course access help; and marketing text messages about program updates, special offers and discounts. You get only the kinds you agreed to.

How to join: only by checking one or both of the optional text message boxes on the form on our Contact page (https://nextgencyberacademy.com/contact-us) and entering your mobile number. The boxes are unchecked until you check them: one for non-marketing texts and one for marketing texts. We text you only about the kinds you checked. Joining is optional and separate from joining our email list; giving us your phone number anywhere else does not sign you up.

• You must be 18 or older to sign up for text messages
• Consent to receive text messages is not a condition of any purchase
• Message frequency varies
• Message and data rates may apply

• Reply STOP at any time to cancel. You will receive one final message confirming you have been unsubscribed
• Carriers are not liable for delayed or undelivered messages

Discord Community

By joining our Discord community, you agree to:

• Treat all members with respect and professionalism
• Not share or redistribute paid course content
• Not spam, harass, or engage in disruptive behavior
• Not solicit other members for competing services
• Follow all rules posted in the Discord server

We reserve the right to remove members who violate these guidelines without refund.

Intellectual Property

All content, materials, and resources provided through our programs, including but not limited to course materials, videos, assessments, guides, and written content, are owned by NextGen Cyber Academy LLC and protected by copyright law.

You may not:

• Copy, reproduce, or distribute our content without written permission
• Share login credentials or paid content with non-enrolled individuals
• Record live sessions without prior written consent
• Use our content for commercial purposes without authorization

Disclaimers

No Guarantee of Employment: NextGen Cyber Academy LLC provides training, career coaching, and job placement guidance. However, we do not guarantee employment, job placement, or any specific career outcome. Your success depends on many factors including your effort, skills, experience, and market conditions.

No Certification Guarantee: Completing our bootcamp does not automatically result in any industry certification. Certification preparation sessions are optional add-ons and passing certification exams depends on your individual preparation and performance.

Educational Content: Our content is provided for educational purposes only. While we strive for accuracy, cybersecurity is a rapidly evolving field and information may become outdated. We are not liable for any decisions made based on our content.

Release of Liability

By using our services, you voluntarily assume all risks associated with participating in our programs, including but not limited to:

• Career decisions made based on information provided through our programs
• Financial decisions related to career changes, certifications, or education
• Outcomes of job applications, interviews, or career transitions
• Technical issues, data loss, or service interruptions
• Interactions with other community members in Discord or live sessions

You hereby release, waive, and forever discharge NextGen Cyber Academy LLC, its owner Justin Crowder, and its employees, contractors, and agents from any and all claims, demands, damages, losses, costs, or expenses (including attorney fees) arising out of or related to your use of our services, regardless of cause.

This release applies to claims of any kind, whether known or unknown, including but not limited to claims of negligence, breach of contract, or breach of warranty.

No Guarantee of Results

NextGen Cyber Academy LLC makes no guarantees, representations, or warranties regarding:

• Employment outcomes, job offers, or job placement
• Salary levels, income, or earning potential
• Certification exam results or pass rates
• Career advancement or promotions
• Return on investment of tuition paid
• Specific skills or competency levels upon completion

All testimonials, case studies, and success stories shared by NextGen Cyber Academy LLC represent individual experiences and are not indicative of typical results. Your results will vary based on your individual effort, background, experience, dedication, market conditions, and many other factors beyond our control.

By enrolling in any NextGen Cyber Academy LLC program, you acknowledge that you are making an investment in education and personal development with no guaranteed outcomes. You accept full responsibility for your own career decisions and results.

Limitation of Liability

To the maximum extent permitted by law, NextGen Cyber Academy LLC and its owners, employees, and agents shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from your use of or inability to use our services
• Actions taken based on content provided through our programs

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless NextGen Cyber Academy LLC, its owners, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights

Modifications to Services and Terms

We reserve the right to:

• Modify, suspend, or discontinue any part of our services at any time
• Update these Terms of Service at any time
• Change pricing for future cohorts (current enrolled students will not be affected)

Material changes will be communicated via email or website notification. Continued use of our services after changes constitutes acceptance.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Fulton County, Georgia.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
