Agreement to Terms

By accessing or using the services provided by NextGen Cyber Academy LLC ("we," "us," or "our"), including our website (nextgencyberacademy.com), bootcamp programs, quizzes, Discord community, and related communications, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Services

NextGen Cyber Academy LLC provides:

• Cybersecurity career training and bootcamp programs

• Online readiness assessments and quizzes

• Educational content and resources

• Discord community access

• Career coaching and mentorship

• Optional certification preparation sessions

• Resume revision services

Eligibility

You must be at least 18 years old to use our services independently. Individuals aged 14-17 may use our services with verified parental or guardian consent and supervision. By enrolling a minor, the parent or guardian agrees to these Terms on behalf of the minor and assumes responsibility for the minor's use of our services. We reserve the right to request proof of parental consent at any time.

Account and Registration

When you create an account, join our waitlist, or enroll in a program, you agree to:

• Provide accurate, current, and complete information

• Maintain and update your information as needed

• Keep your account credentials confidential

• Notify us immediately of any unauthorized use of your account

• Accept responsibility for all activity under your account

Bootcamp Enrollment and Payments

Waitlist:

• Joining the free waitlist does not guarantee a seat in the bootcamp

• Waitlist members will be notified when enrollment opens

• Paid reservations receive priority over free waitlist entries

Deposit ($197):

• The deposit reserves your seat in the next available cohort

• Deposits are non-refundable

• The deposit amount is applied toward your total tuition

• Remaining balance ($800) is due when the cohort officially opens

• If you fail to pay the remaining balance by the deadline, your seat may be released and your deposit is forfeited

Early Bird Full Payment ($897):

• Full payment at the early bird price guarantees your enrollment

• This represents a $100 discount off the standard price ($997)

• Non-refundable once the cohort begins

Standard Full Payment ($997):

• Full tuition price when the early bird discount is not available

• Guarantees your enrollment in the next available cohort

• Non-refundable once the cohort begins

Resume Revision Service ($5):

• One-time payment for professional resume review and feedback

• Non-refundable once the service has been delivered

• Turnaround time varies based on demand

Premium Discord Access:

• Paid subscription for enhanced Discord community features

• Non-refundable after access has been granted

• We reserve the right to revoke access for community guideline violations without refund

Refund Policy

All sales are final. All payments made to NextGen Cyber Academy LLC are non-refundable, including but not limited to:

- Deposits ($197): Non-refundable

- Early bird full payment ($897): Non-refundable

- Standard full payment ($997): Non-refundable

- Resume Revision ($5): Non-refundable

- Premium Discord Access: Non-refundable

By making a payment, you acknowledge and agree that all transactions are final and no refunds will be issued under any circumstances, except in the following case:

- Cohort cancellation by NextGen Cyber Academy LLC: If we cancel a cohort and are unable to reschedule, all payments (including deposits) will be fully refunded

No chargebacks: You agree not to initiate a chargeback or payment dispute with your bank or credit card company for any completed transaction. If a chargeback is initiated, you agree to reimburse NextGen Cyber Academy LLC for any fees incurred as a result, and your access to all services will be immediately revoked.

Discord Community

By joining our Discord community, you agree to:

• Treat all members with respect and professionalism

• Not share or redistribute paid course content

• Not spam, harass, or engage in disruptive behavior

• Not solicit other members for competing services

• Follow all rules posted in the Discord server

We reserve the right to remove members who violate these guidelines without refund.

Intellectual Property

All content, materials, and resources provided through our programs — including but not limited to course materials, videos, assessments, guides, and written content — are owned by NextGen Cyber Academy LLC and protected by copyright law.

You may not:

• Copy, reproduce, or distribute our content without written permission

• Share login credentials or paid content with non-enrolled individuals

• Record live sessions without prior written consent

• Use our content for commercial purposes without authorization

Disclaimers

No Guarantee of Employment: NextGen Cyber Academy LLC provides training, career coaching, and job placement guidance. However, we do not guarantee employment, job placement, or any specific career outcome. Your success depends on many factors including your effort, skills, experience, and market conditions.

No Certification Guarantee: Completing our bootcamp does not automatically result in any industry certification. Certification preparation sessions are optional add-ons and passing certification exams depends on your individual preparation and performance.

Educational Content: Our content is provided for educational purposes only. While we strive for accuracy, cybersecurity is a rapidly evolving field and information may become outdated. We are not liable for any decisions made based on our content.

Release of Liability

By using our services, you voluntarily assume all risks associated with participating in our programs, including but not limited to:

• Career decisions made based on information provided through our programs

• Financial decisions related to career changes, certifications, or education

• Outcomes of job applications, interviews, or career transitions

• Technical issues, data loss, or service interruptions

• Interactions with other community members in Discord or live sessions

You hereby release, waive, and forever discharge NextGen Cyber Academy LLC, its owner Justin Crowder and Crowder J Consulting LLC, employees, contractors, affiliates, and agents from any and all claims, demands, damages, losses, costs, or expenses (including attorney fees) arising out of or related to your use of our services, regardless of cause.

This release applies to claims of any kind, whether known or unknown, including but not limited to claims of negligence, breach of contract, or breach of warranty.

No Guarantee of Results

NextGen Cyber Academy LLC makes no guarantees, representations, or warranties regarding:

• Employment outcomes, job offers, or job placement

• Salary levels, income, or earning potential

• Certification exam results or pass rates

• Career advancement or promotions

• Return on investment of tuition paid

• Specific skills or competency levels upon completion

All testimonials, case studies, and success stories shared by NextGen Cyber Academy LLC represent individual experiences and are not indicative of typical results. Your results will vary based on your individual effort, background, experience, dedication, market conditions, and many other factors beyond our control.

By enrolling in any NextGen Cyber Academy LLC program, you acknowledge that you are making an investment in education and personal development with no guaranteed outcomes. You accept full responsibility for your own career decisions and results.

Limitation of Liability

To the maximum extent permitted by law, NextGen Cyber Academy LLC and its owners, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, or consequential damages

• Loss of profits, data, or business opportunities

• Damages resulting from your use of or inability to use our services

• Actions taken based on content provided through our programs

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless NextGen Cyber Academy LLC, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of our services

• Your violation of these Terms

• Your violation of any third-party rights

Modifications to Services and Terms

We reserve the right to:

• Modify, suspend, or discontinue any part of our services at any time

• Update these Terms of Service at any time

• Change pricing for future cohorts (current enrolled students will not be affected)

Material changes will be communicated via email or website notification. Continued use of our services after changes constitutes acceptance.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Fulton County, Georgia.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
